Terms of Use

These terms are an agreement between you and FireUp Lab, LLC (“we”, “us”) for your use of the Smalljoy app. By downloading or using Smalljoy, you agree to them. If you don’t agree, please don’t use the app.

1. Using Smalljoy

Smalljoy lets you save moments from your children’s lives: notes, voice recordings, photos, and videos. You must be at least 18 years old, or the age of majority where you live, to use Smalljoy and to buy a subscription.

We grant you a personal, non-transferable, non-exclusive license to use Smalljoy on Apple devices that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, modify, resell, or reverse engineer the app, except where the law allows it.

2. Your content

Everything you add to Smalljoy is yours: text, recordings, photos, videos, and your children’s details. We don’t claim any ownership of it. Your content is stored on your device, and in iCloud if you use family sharing. We don’t store it on our servers and can’t access it.

You’re responsible for what you add and share. Only add content you have the right to keep, and only invite people you trust to your shared family.

Keeping your content safe is your responsibility. Content stored only on your phone can be lost if you delete the app or lose or reset your phone and have no device backup. We can’t recover it for you.

3. Subscriptions and free trial

Smalljoy requires a subscription after a free trial. Subscriptions are sold through Apple’s App Store:

  • Plans: monthly and yearly. Current prices are shown in the app before you buy and may vary by country.

  • Free trial: eligible new subscribers get a 7-day free trial. If you don’t cancel at least 24 hours before the trial ends, your subscription starts and your Apple Account is charged for the plan you chose. Each Apple Account can use the free trial once.

  • Automatic renewal: your subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. Your Apple Account is charged for renewal within 24 hours before the current period ends.

  • Cancelling: you can manage or cancel your subscription anytime in your iPhone’s Settings > [your name] > Subscriptions. Cancelling stops future renewals; you keep access until the end of the period you’ve paid for.

  • Refunds: payments are handled by Apple. Refund requests go through Apple at https://reportaproblem.apple.com.

  • Price changes: if a price changes, Apple will tell you in advance as its rules require, and you can cancel before the new price applies.

A subscription covers the Apple Account that bought it. Each person who uses Smalljoy on their own Apple Account needs their own trial or subscription, including people invited to a shared family.

4. Family sharing

If you share your family’s moments through iCloud, the people you invite can see, add, and change moments in that family. Shared content uses the iCloud storage of the person who started sharing. You can remove people or stop sharing at any time in the app. iCloud is provided by Apple, and Apple’s terms apply to it.

5. Acceptable use

Don’t use Smalljoy to store or share illegal content, to harm anyone, or to try to break, overload, or get around the app’s security or subscription checks.

6. Availability and changes

We work to keep Smalljoy running well, but we don’t promise it will always be available or free of errors. We may change, add, or remove features. If we ever stop offering Smalljoy, we’ll try to give reasonable notice so you can keep your content.

7. Disclaimer

Smalljoy is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Speech-to-text transcription may contain mistakes; please review your moments before saving.

8. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, or consequential damages, or for any loss of data or content, arising from your use of Smalljoy. Our total liability for any claim relating to Smalljoy is limited to the amount you paid for Smalljoy in the 12 months before the claim. Some places don’t allow these limits, so they may not fully apply to you.

9. Apple terms

These terms are between you and us, not Apple. Apple is not responsible for Smalljoy or its content.

  • Apple has no obligation to provide maintenance or support for Smalljoy.

  • If Smalljoy fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for Smalljoy.

  • Apple is not responsible for any claims by you or anyone else relating to Smalljoy or your use of it. This includes product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy, or similar laws.

  • If anyone claims that Smalljoy or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling, and resolving that claim.

  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.

  • You must follow any third-party terms that apply when you use Smalljoy, such as your mobile carrier’s.

  • Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple may enforce them against you.

10. Ending these terms

You can stop using Smalljoy at any time by deleting the app and cancelling your subscription. We may suspend or end your access if you seriously break these terms. Sections 2 and 7 to 11 continue to apply after these terms end.

11. Governing law

These terms are governed by the laws of the State of North Carolina, USA, except where the law of the country you live in gives you consumer protections that can’t be waived.

12. Changes to these terms

We may update these terms from time to time. We’ll update the effective date above and, for significant changes, let you know in the app. If you keep using Smalljoy after changes take effect, you accept the updated terms.
